'Equal rights in practice' : Issue 2

The latest news review of the Community Action Programme to combat discrimination is now available


‘Equal rights in practice’ is the bi-annual news review of the Community Action Programme to combat discrimination (2001 – 2006), supported by the Anti-discrimination and relations with civil society Unit, Employment and Social Affairs DG.  Issue 2 is now available in English, French and German. This issue outlines the state-of-play across the EU in relation to the transposition of the Article 13 Directives, and explores two other key areas of Action Programme support: data collection and the work of European-level umbrella NGOs.  News of upcoming events, publications and the campaign “For Diversity, Against Discrimination” are regular features of the news review.  This issue’s special focus is on the Roma in an enlarged European Union in anticipation of the forthcoming report commissioned by the EC.

CRITICAL REVIEW OF ACADEMIC LITERATURE RELATING TO THE EU DIRECTIVES TO COMBAT DISCRIMINATION (PDF)

The inclusion of Article 13 in the Treaty of Amsterdam extended the powers of the EU in the field of combating discrimination and gave rise to two new Directives setting out to implement the principles of non discrimination across the EU: Directive 2000/43/EC implementing the principle of equal treatment irrespective of racial or ethnic origin and Directive 2000/78/EC establishing a general framework for equal treatment in employment and occupation. The innovative approach of the Directives has attracted considerable attention from both policy-makers and the academic world, and there is a growing body of academic literature referring to the Directives. This report provides an analytical overview of this body of literature, primarily in 15 Member States of the EU. It presents the key tendencies in thinking around the Directives and highlights the main conclusions presented in these studies.
