Toelichting bij Internationaal Verdrag inzake Burgerrechten en Politieke Rechten

In discriminatiezaken wordt vaak een beroep gedaan op het in artikel 26 van het Internationaal Verdrag inzake Burgerrechten en Politieke Rechten (afgekort: BuPo of IVBPR) geformuleerd gelijkheidsgebod en discriminatieverbod:

'Allen zijn gelijk voor de wet en hebben zonder discriminatie aanspraak op gelijke behandeling door de wet. In dit verband verbiedt de wet discriminatie van welke aard dan ook en garandeert een ieder gelijke en doelmatige bescherming tegen discriminatie op welke grond dan ook, zoals ras, huidskleur, geslacht, taal, godsdienst, politieke of andere overtuiging, nationale of maatschappelijke afkomst, eigendom, geboorte of andere status.'

Deze verdragsbepaling heeft rechtstreekse werking zodat op grond van artikel 94 GW wettelijke voorschriften die niet verenigbaar zijn met deze verdragsbepaling buiten toepassing gelaten worden.
De rechter kan dus aan de hand van het beginsel zoals het in artikel 26 IVBPR is neergelegd de inhoud van wettelijke bepalingen aan een toetsing onderwerpen.
